कोयला मंत्रालय ने 'कोल ब्लॉक आवंटन (संशोधन) नियम, 2026' के तहत परफॉरमेंस बैंक गारंटी (PBG) की जगह 'इंश्योरेंस श्योरिटी बांड' (ISB) के उपयोग को मंजूरी दी है। इस कदम से कोयला खदान आवंटियों का वित्तीय बोझ कम होगा और कारोबार में आसानी (Ease of doing business) होगी।

📌 सुधार का संदर्भ (Context): कोयला क्षेत्र में 'ईज ऑफ डूइंग बिजनेस' (Ease of Doing Business) को और मजबूत करने के लिए कोयला मंत्रालय ने एक अहम वित्तीय सुधार पेश किया है। कोल ब्लॉक आवंटन (संशोधन) नियम, 2026 के तहत, मंत्रालय ने अब परफॉरमेंस बैंक गारंटी (PBG) की जगह 'इंश्योरेंस श्योरिटी बांड' (ISB) के उपयोग को आधिकारिक मंजूरी दे दी है।

⚙️ संशोधन के मुख्य बिंदु:

  • PBG का नया विकल्प: खान और खनिज (विकास और विनियमन) अधिनियम, 1957 के तहत कोयला ब्लॉक आवंटियों को अब अपने प्रदर्शन सुरक्षा दायित्वों (performance security obligations) को पूरा करने के लिए परफॉरमेंस बैंक गारंटी और इंश्योरेंस श्योरिटी बांड (ISB) के बीच चयन करने की छूट मिलेगी।
  • मौजूदा आवंटियों को भी छूट: संशोधित ढांचा इस लचीलेपन को मौजूदा आवंटनों तक भी बढ़ाता है। यानी वे निर्धारित शर्तों के अनुसार अपने पहले से जमा किए गए PBG को ISB से आसानी से बदल सकते हैं।
  • वित्तीय बोझ में कमी: मंत्रालय ने जोर देकर कहा कि इस बड़े कदम का उद्देश्य पारंपरिक बैंक गारंटी व्यवस्था से जुड़े भारी वित्तीय बोझ को कम करना है।

📈 पूंजी का बेहतर उपयोग

बैंक गारंटी के कारण फंसी रहने वाली पूंजी (Capital) के आजाद होने से कोयला ब्लॉक आवंटियों को बड़ी राहत मिलेगी। वे अब अपनी इस पूंजी का उपयोग खदान विकास (mine development) और परिचालन गतिविधियों के लिए अधिक कुशलता से कर सकेंगे।

📌 Context of the Reform: In a major move to further strengthen the 'Ease of Doing Business', the Ministry of Coal has introduced a key financial reform for coal block allocators. Through the newly notified Coal Blocks Allocation (Amendment) Rules, 2026, the Ministry has officially enabled the use of Insurance Surety Bonds (ISBs).

  • Replacement of PBGs: Allocators of coal blocks under the Mines and Minerals (Development and Regulation) Act, 1957 can now use Insurance Surety Bonds (ISBs) in place of traditional Performance Bank Guarantees (PBGs) to fulfill their performance security obligations.
  • Flexibility for Existing Allocations: The amended framework provides flexibility not just to new allocators but also extends to existing ones. They are now permitted to seamlessly replace their already furnished PBGs with ISBs subject to prescribed conditions.
  • Easing Financial Burden: This highly anticipated measure is specifically aimed at easing the heavy financial burden associated with conventional bank guarantee arrangements.
